This agreement is made on the date it is accepted below between the company named at checkout ("Client") and Kihan Marketing.
1. The plan
Client subscribes to Website care and hosting, Care Plus, as described on kihanmarketing.com/pricing/ on the date of this agreement, at $350 a month.
The plan includes the work listed for it on the pricing page on the date of this agreement. Work outside that list is quoted separately before it starts.
Not included unless the plan says so: ad spend, lead costs charged by Google or Meta, software subscriptions, hosting, the domain, paid directory listings, photography, and stock or licensed images and fonts.
2. Payment
The plan is billed monthly in advance, by debit or credit card through PayPal. The first payment is taken at checkout and sets the billing date. Each later payment is taken automatically on the same date each month until the plan ends. Kihan Marketing never sees or stores Client's card details.
Ad spend and lead costs are paid by Client directly to the ad platform, on Client's own payment method. Kihan Marketing never holds or pays Client's ad budget.
Monthly fees are not refundable for a month that has started. If a payment fails, PayPal tries again; if it fails twice, the plan is paused, and work pauses until the payment is made. If Client disputes a charge with their bank instead of contacting Kihan Marketing first, Kihan Marketing may pause the work until it is resolved.
3. Term and cancellation
The plan has a minimum term of 3 months from the first payment. After that it continues month to month.
Either side may end the plan by giving 30 days' written notice by email. Notice can be given at any time, including during the minimum term, but the plan cannot end before the minimum term is complete. Client pays for the months that start before the end date. Kihan Marketing cancels the PayPal subscription so that no payment is taken after the end date.
4. Changing plans
Client may move to a higher plan at any time; the new price applies from the next billing date. Client may move to a lower plan after the minimum term, with the change applying from the next billing date. Moving to a plan for a different service starts a new agreement for that service.
5. What Client provides
Work starts once Client has given the access the plan needs, which may include the website, Google Business Profile, Google Analytics, Search Console, ad accounts and the property management or booking software. Client answers questions and approves drafts within 5 business days. Delays on Client's side move the work back by the same amount of time, and the monthly fee is still due.
Client confirms that it owns or has the right to use everything it sends, and that the facts it gives (prices, policies, availability, licences, offers) are accurate. Kihan Marketing writes from those facts and does not present generated images as Client's real premises or products.
6. Ownership
Client's website, Google Business Profile, analytics, ad accounts and the content Kihan Marketing writes for Client belong to Client, and stay in Client's name. Kihan Marketing keeps ownership of its own tools, templates, plugins and methods, and grants Client a permanent licence to use any that are part of the delivered work. Kihan Marketing may name Client and show the work in its portfolio unless Client asks it not to in writing.
7. Results
Search, ads and AI answers depend on platforms and competitors outside either side's control. Kihan Marketing does not promise rankings, traffic, citations, leads, leases or sales. It reports each month on the work done and the measures agreed at the start.
8. Third parties
Kihan Marketing is not responsible for changes, outages, policy decisions or account suspensions by Google, Meta, PayPal, hosting providers, software vendors or other third parties. Where such a change needs extra work, Kihan Marketing says what it involves before doing it.
9. Confidentiality
Each side keeps the other's non-public business information private and uses it only for this work.
10. Limits
Kihan Marketing's total liability under this agreement is limited to the fees Client paid in the 3 months before the claim. Neither side is liable for indirect or lost-profit damages.
11. General
This agreement and the plan description on the date of purchase are the whole agreement for this plan. Changes must be in writing and accepted by both sides. Accepting on the checkout page, by ticking the box and typing a full name, is Client's signature.
